These Terms and Conditions ("Terms") govern your access to and use of the Wobble mobile applications, websites, services and related technology (collectively, the "Wobble Platform").
The Wobble Platform is operated by WOBBLE TECHNOLOGIES LIMITED, trading as Wobble ("Wobble", "we", "us" or "our").
By creating an account, accessing the Wobble Platform or placing an order or delivery request through Wobble, you agree to these Terms.
If you do not agree to these Terms, you must not use the Wobble Platform.
1. About Wobble
Wobble provides a technology platform that connects customers with independent merchants, restaurants, shops, delivery partners and other service providers.
Depending on the service being used, Wobble may facilitate:
- discovery of merchants and products;
- placement and management of orders;
- electronic payments;
- communication between customers, merchants and delivery partners;
- delivery arrangements;
- location and route information; and
- customer support.
Unless Wobble expressly states otherwise, products offered through the Platform are sold and prepared by the relevant merchant.
Delivery services may be performed by independent delivery partners, merchant-employed delivery personnel or, where applicable, Wobble-operated delivery services.
Nothing in these Terms removes any rights or remedies which cannot lawfully be excluded under applicable Zambian law.
2. Eligibility
You must have the legal capacity to enter into a binding agreement to use the Wobble Platform.
If you use Wobble on behalf of another person, business or organisation, you represent that you have authority to do so.
You must provide accurate information when creating or using your account.
3. Your Account
You are responsible for maintaining the confidentiality and security of your Wobble account, authentication credentials and devices.
You must notify Wobble promptly if you believe that:
- your account has been accessed without permission;
- your phone or authentication credentials have been compromised; or
- fraudulent transactions have occurred through your account.
You may not:
- create accounts using false identities;
- impersonate another person;
- sell or transfer your account;
- use another person's account without permission; or
- use Wobble for fraudulent, unlawful or abusive activity.
Wobble may temporarily restrict or suspend an account where reasonably necessary to investigate suspected fraud, misuse, security incidents or violations of these Terms.
4. Location Information
Certain Wobble services depend on location information.
You are responsible for providing an accurate delivery or pickup location.
Where you permit location access, Wobble may use device location information to:
- determine available merchants;
- estimate delivery distances;
- calculate or estimate delivery fees;
- assist delivery partners with navigation;
- display delivery progress;
- prevent fraud; and
- operate and improve the service.
GPS, mobile networks, mapping providers and other location technologies may occasionally provide inaccurate information.
You should therefore verify your delivery address and map pin before confirming an order.

5. Orders
When you place an order through Wobble, you are making a request to purchase the selected products from the relevant merchant.
An order is not necessarily accepted simply because it has been submitted.
An order may be rejected or cancelled where, for example:
- the merchant is closed;
- an item is unavailable;
- payment cannot be completed;
- the delivery location cannot reasonably be serviced;
- pricing or product information contains an obvious error;
- the merchant rejects the order;
- no suitable delivery partner is available; or
- fraud or misuse is reasonably suspected.
Where payment has already been collected for an order that cannot be fulfilled, any refund due will be processed in accordance with the applicable refund rules and payment-provider procedures.
6. Merchant Responsibility
Merchants are responsible for information relating to the goods they offer, including, where applicable:
- product descriptions;
- ingredients;
- preparation;
- food handling;
- product quality;
- product availability;
- packaging;
- merchant-specific pricing; and
- compliance with laws applicable to their businesses and products.
Wobble may provide tools allowing merchants to manage this information but does not independently manufacture or prepare products offered by merchants.
This provision does not exclude any responsibility Wobble may have under applicable law.
7. Food Allergies and Dietary Requirements
Food may contain allergens or ingredients that are not apparent from a menu description.
Where you have an allergy, intolerance, medical dietary requirement or other serious ingredient concern, you should contact the merchant directly before ordering.
Information displayed through Wobble regarding ingredients or dietary classifications may originate from merchants.
Wobble does not guarantee that food has been prepared in an allergen-free environment unless expressly confirmed by the merchant responsible for preparing it.
8. Pricing
Prices displayed on Wobble may include different components, including:
- item prices;
- delivery fees;
- service fees;
- small-order fees;
- taxes;
- promotional discounts; and
- other charges clearly disclosed before checkout.
The total payable amount will be displayed before you confirm your order.
Prices available through Wobble may differ from prices offered directly by a merchant through another sales channel.
Merchants may determine their own product prices unless otherwise stated.
Wobble may change applicable platform or delivery fees from time to time, but changes will not retrospectively increase the amount of an order you have already confirmed.
9. Estimated Delivery Times
Delivery and preparation times shown on Wobble are estimates unless expressly stated otherwise.
Actual delivery times may be affected by circumstances including:
- merchant preparation time;
- traffic;
- weather;
- road conditions;
- delivery distance;
- order volume;
- availability of delivery partners;
- incorrect delivery information;
- security restrictions; and
- events outside reasonable control.
Wobble does not guarantee an exact delivery time merely because an estimated time is displayed.
However, this does not affect any rights you may have where a service has not been provided within a reasonable period or as otherwise required by law.
10. Delivery
You must provide sufficient information to allow the delivery partner to locate you.
You should remain reasonably available using the contact details supplied with your order.
A delivery partner may contact you when:
- clarification of your location is required;
- access to the premises is restricted; or
- the delivery partner has arrived.
Where a delivery partner cannot complete delivery because the customer:
- supplied an incorrect address;
- is unreachable after reasonable attempts;
- refuses to receive the order without lawful justification; or
- prevents safe access to the delivery location,
the order may be treated in accordance with Wobble's cancellation and refund rules.
Perishable goods which cannot reasonably be returned or redelivered may not qualify for a refund where failure of delivery was caused by the customer's actions.
11. Delivery Partner Location
For certain active deliveries, Wobble may display the approximate location of the delivery partner assigned to the order.
This information is provided for delivery coordination and convenience only.
You must not:
- track a delivery partner after the delivery has ended;
- use location information to harass, threaten or intimidate a delivery partner;
- attempt to determine a delivery partner's private residence;
- publish a delivery partner's location without lawful authority; or
- use delivery information for purposes unrelated to the delivery.
Location information may be delayed or inaccurate because of GPS, network or device conditions.
12. Payments
Wobble may facilitate payments using supported payment methods, including mobile money and other electronic payment services.
Payments may be processed by third-party payment providers.
By selecting a payment method, you authorise the applicable payment to be initiated for the amount displayed at checkout.
Wobble does not require users to disclose mobile money PINs or other secret authentication credentials directly to Wobble.
You must never provide your mobile-money PIN, OTP, password or other confidential financial authentication credential to a merchant, courier or person claiming to represent Wobble.
Payment processing may be subject to additional terms imposed by the relevant payment provider.
13. Refunds
Refund eligibility depends on the circumstances of the order and applicable law.
A customer may be entitled to a full or partial refund where, for example:
- an order was cancelled before fulfilment in circumstances qualifying for a refund;
- paid items were not delivered;
- materially incorrect items were supplied;
- items were materially defective or unsuitable;
- duplicate payment occurred; or
- another refund right exists under applicable law.
Wobble may request reasonable supporting information such as photographs, order information or a description of the issue before resolving a refund request.
Refunds may be returned through the original payment method or another lawful method made available by Wobble.
Processing times may depend on the relevant bank, mobile-money operator or payment provider.
Nothing in these Terms limits any mandatory consumer refund rights.
14. Cancellations
Cancellation rules may differ depending on the status of an order.
A customer may ordinarily cancel an order before the merchant begins preparing it without being charged for goods not supplied, subject to any clearly disclosed and lawful charges.
Once preparation has begun, cancellation may result in a charge reflecting products already prepared or reasonable costs incurred.
An order may also be cancelled by Wobble or a merchant where fulfilment becomes impossible or unreasonable.
Specific cancellation rules displayed before or during an order form part of these Terms.
15. Promotions and Discounts
Promotional offers may be subject to additional conditions.
Unless otherwise stated:
- promotions have no cash value;
- promotions cannot be sold or transferred;
- promotions may have expiry dates;
- promotions may be restricted by merchant, location, user, product or minimum order value;
- only one promotion may apply to an order where specified; and
- promotions obtained through fraud, manipulation or technical exploitation may be cancelled.
Wobble will disclose material promotional conditions applicable to an offer.
16. Reviews and User Content
Wobble may allow customers to submit ratings, photographs, comments and reviews.
You retain ownership of content that you create, but grant Wobble a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, format and use that content for operating and promoting the Wobble Platform.
You must not submit content that:
- is knowingly false or misleading;
- contains unlawful threats or harassment;
- infringes another person's intellectual property;
- reveals another person's private information without authority;
- contains malicious software;
- constitutes spam;
- is discriminatory or abusive;
- involves fraud; or
- violates applicable law.
Wobble may moderate or remove content where reasonably necessary to enforce these Terms or comply with law.
17. Prohibited Use
You must not use Wobble to:
- commit fraud;
- make fraudulent payment claims;
- place deliberately false orders;
- harass merchants, customers, employees or delivery partners;
- distribute malware;
- attempt unauthorised access to Wobble's systems;
- scrape or systematically extract Platform data without authorisation;
- interfere with Platform security;
- manipulate prices, promotions, ratings or referral systems;
- create artificial transactions;
- reverse engineer protected portions of the Platform except where legally permitted;
- facilitate the sale or transportation of unlawful items; or
- violate applicable law.
18. Restricted Items
Certain products may be restricted or prohibited from sale or delivery through Wobble.
Wobble may prohibit or restrict listings involving products such as:
- illegal drugs;
- stolen goods;
- weapons or dangerous items where prohibited;
- counterfeit products;
- hazardous substances;
- products whose sale is unlawful;
- age-restricted products where appropriate age-verification procedures are unavailable; and
- any other product Wobble reasonably determines cannot lawfully or safely be distributed using the Platform.
19. Fraud and Abuse
Wobble may use automated and manual systems to detect suspected:
- account takeover;
- payment fraud;
- promotion abuse;
- false refund claims;
- merchant fraud;
- courier fraud; and
- other suspicious activity.
Where reasonably necessary, Wobble may temporarily restrict transactions or accounts while an investigation is conducted.
Users may contact Wobble to challenge an account action or provide additional information.
20. Safety
Users, merchants and delivery partners must treat each other respectfully.
Threatening, violent, sexually inappropriate, discriminatory, abusive or dangerous conduct is prohibited.
Delivery partners are not required to enter premises or locations they reasonably believe are unsafe.
Customers must not require delivery partners to operate vehicles unlawfully or unsafely.
Serious safety incidents may result in suspension or permanent removal from the Platform and, where appropriate or legally required, referral to relevant authorities.
21. Third-Party Services
Wobble may depend on services provided by third parties, including:
- mapping providers;
- telecommunications providers;
- cloud infrastructure providers;
- mobile-money operators;
- banks;
- payment processors; and
- authentication providers.
Wobble is not responsible for failures caused exclusively by third-party systems outside Wobble's reasonable control.
Where appropriate, Wobble will take reasonable steps to restore affected Platform functionality.
22. Availability of the Platform
Wobble aims to provide a reliable service but does not guarantee uninterrupted availability.
The Platform may occasionally be unavailable because of:
- maintenance;
- software updates;
- network failures;
- infrastructure failures;
- security incidents;
- telecommunications outages; or
- circumstances beyond Wobble's reasonable control.
Wobble may modify, suspend or discontinue features where reasonably necessary.
23. Intellectual Property
The Wobble name, applications, software, designs, interfaces, graphics, logos, trademarks and related intellectual property belong to Wobble or its licensors.
Except where expressly permitted, users may not reproduce, distribute, modify, sell, license or commercially exploit Wobble's intellectual property.
These Terms provide you with a limited, revocable, non-exclusive and non-transferable right to use the Wobble Platform for its intended purpose.
24. Disclaimer of Warranties
Wobble will exercise reasonable care in providing the Platform.
However, to the maximum extent permitted by applicable law, Wobble does not warrant that:
- every merchant will always be available;
- every product will always be available;
- delivery estimates will always be exact;
- mapping information will always be accurate;
- the Platform will never experience interruptions; or
- third-party systems will never fail.
Nothing in this section excludes warranties, guarantees or rights which cannot lawfully be excluded.
25. Limitation of Liability
To the maximum extent permitted by applicable law, Wobble will not be liable for indirect, incidental, special or consequential losses that were not reasonably foreseeable as a result of Wobble's breach.
Wobble is not responsible for losses caused solely by:
- inaccurate information supplied by the user;
- unlawful use of the Platform;
- circumstances beyond Wobble's reasonable control;
- unauthorised use of an account caused by the user's failure to protect their credentials; or
- independent acts of third parties for which Wobble is not legally responsible.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.
In particular, nothing in these Terms is intended to exclude liability for fraud, wilful misconduct or any other liability which cannot lawfully be excluded.
26. Indemnity for Misuse
To the extent permitted by law, you are responsible for losses reasonably incurred by Wobble as a direct result of your:
- fraudulent use of the Platform;
- intentional violation of applicable law;
- infringement of third-party intellectual-property rights; or
- deliberate material breach of these Terms.
This provision does not require a consumer to compensate Wobble for losses for which the consumer is not legally responsible.
27. Account Suspension and Termination
Wobble may suspend or terminate access to the Platform where reasonably justified, including where a user:
- commits fraud;
- creates a serious safety risk;
- repeatedly violates these Terms;
- uses Wobble for unlawful purposes;
- abuses customers, merchants or delivery partners;
- compromises Platform security; or
- causes material harm to Wobble or other users.
Where circumstances permit, Wobble may provide notice or an opportunity to resolve the issue before permanent termination.
Immediate restriction may be imposed where necessary to protect users, investigate fraud, comply with law or address an urgent security or safety risk.
28. Privacy
Wobble processes personal information in accordance with its Privacy Policy and applicable data-protection law.
Depending on the service being used, information processed may include:
- identity and account information;
- contact details;
- delivery addresses;
- device information;
- location information;
- transaction and order history;
- customer-service communications; and
- security and fraud-prevention information.
The Wobble Privacy Policy explains in more detail how information is collected, used, stored, shared and protected and how users may exercise applicable data rights.
29. Electronic Communications
By using Wobble, you agree that transactional communications may be sent electronically where permitted by law, including:
- order confirmations;
- payment notifications;
- delivery updates;
- security alerts;
- account notifications; and
- changes affecting the service.
Marketing communications will be handled in accordance with applicable law and the preferences available to you.
30. Changes to These Terms
Wobble may update these Terms to reflect:
- changes in law;
- new services or features;
- security requirements;
- operational changes; or
- changes to Wobble's business model.
Material changes will be communicated through the Platform or another reasonable method.
Where required, you may be asked to accept materially revised Terms before continuing to use the Platform.
Changes will not retrospectively alter completed transactions unless required by law.
31. Electronic Transactions and Consumer Rights
Before you finally place an order, Wobble will provide an opportunity to review the transaction, correct mistakes and withdraw from the transaction.
Wobble will make an electronic order record or confirmation available through the Platform or an appropriate electronic communication. You should retain that record for your own reference.
The supplier information, pricing, payment method, delivery estimate and applicable cancellation and refund terms required for a transaction are provided through the Platform, these Terms, the checkout flow and the relevant merchant listing.
Wobble uses payment systems designed to meet accepted security standards appropriate to the transaction. You remain responsible for using the authorised payment-provider interface and protecting your secret credentials.
Rights provided under the Electronic Communications and Transactions Act, 2021 and other applicable consumer-protection law apply where relevant. Statutory cooling-off rights may not apply to food, beverages, everyday goods delivered to a home or workplace, personalised goods, perishable goods, or services already fully performed with consent. Nothing in these Terms excludes a consumer right that cannot lawfully be excluded.
32. Complaints and Dispute Resolution
If you experience a problem with an order or Wobble service, you should first contact Wobble Support so that the issue can be investigated.
Wobble and the customer should attempt in good faith to resolve disputes through the internal complaints process.
Nothing in these Terms prevents a consumer from exercising any right to approach an appropriate regulatory authority, tribunal or court where entitled to do so.
33. Governing Law
These Terms are governed by the laws of the Republic of Zambia.
Subject to any mandatory consumer rights or dispute-resolution procedures, disputes arising from these Terms or the use of Wobble shall be subject to the jurisdiction of the competent courts of Zambia.
34. Force Majeure
Wobble will not be responsible for failure or delay caused by circumstances beyond its reasonable control, including:
- severe weather;
- natural disasters;
- civil disturbance;
- government restrictions;
- widespread telecommunications failures;
- widespread payment-network failures;
- epidemics or public-health emergencies;
- strikes affecting essential services; or
- other comparable events outside Wobble's reasonable control.
This section does not affect obligations which cannot legally be excluded.
35. Severability
If any provision of these Terms is held to be unlawful or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue to apply where legally possible.
36. No Waiver
A failure by Wobble to enforce a provision of these Terms on one occasion does not constitute a waiver of Wobble's right to enforce that provision later.
37. Entire Agreement
These Terms, together with policies expressly incorporated into them, constitute the agreement governing your use of the Wobble Platform.
Additional terms may apply to specific services, promotions or features and will be disclosed where applicable.

By creating a Wobble account, placing an order or otherwise continuing to use the Wobble Platform after being presented with these Terms, you acknowledge that you have read and agreed to these Terms.
